1. Definitions

"Service" refers to the document organization, family conversation facilitation, and archiving services offered by Ambervale Archive.

"User", "you", or "your" refers to any person engaging our Service.

"We", "us", or "our" refers to Ambervale Archive.

"Agreement" refers to these Terms & Conditions together with any service-specific arrangement made at booking.

2. Acceptance of Terms

By booking or using our Service, you agree to be bound by this Agreement. You confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement on behalf of yourself or your household.

3. Service Description

We provide three staged services: the Document Inventory Session, the Family Wishes Documentation Workshop, and the Generational Archive Package, as described on our Solutions page. Services are currently available to households located in Bangkok and surrounding areas of Thailand and are subject to facilitator availability.

4. User Responsibilities

You agree to provide accurate information when booking a session and to treat facilitators with respect during scheduled visits. You agree not to request that facilitators provide legal, financial, or medical advice, as this falls outside the scope of our Service.

Prohibited conduct includes providing false household information, requesting services for unlawful purposes, or attempting to use session content to circumvent legal requirements applicable to estate or inheritance matters.

5. Intellectual Property

Our website content, templates, and branded materials remain the property of Ambervale Archive. You are granted a limited, non-exclusive license to use provided templates solely for your own household documentation purposes.

Documents, inventories, and archive materials created during your session belong to you and your family. We claim no ownership over household records or personal content generated through our Service.

6. Payment Terms

Pricing for each service is published in Thai baht (฿) on our Solutions page: ฿4,100 for the Document Inventory Session, ฿13,200 for the Family Wishes Documentation Workshop, and ฿32,000 for the Generational Archive Package.

Payment arrangements are confirmed at the time of booking. If a session is cancelled with reasonable notice before it begins, we will discuss an appropriate adjustment on a case-by-case basis.

7. Service-Specific Terms

Sessions are delivered at the household's location or another mutually agreed venue. Scope changes requested after a session begins, such as adding rooms or documents to review, may affect timing and require a separate arrangement.

All information shared with facilitators during a session is treated as confidential household information, used solely to deliver the requested service.

8. Disclaimers

Our Service is provided on an "as is" basis. We make no guarantee regarding specific outcomes, such as the resolution of family disagreements or the legal validity of any documented wishes.

We are not lawyers, accountants, or financial advisors, and nothing provided through our Service constitutes legal, financial, or tax advice. Families should consult an appropriately qualified professional for such matters.

9. Limitation of Liability

To the extent permitted by Thai law, our liability arising from the Service is limited to the amount paid for the specific session in question. We are not liable for indirect, incidental, or consequential damages, including those arising from decisions made based on organized records.

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural events or circumstances affecting travel within Bangkok.

10. Indemnification

You agree to hold Ambervale Archive harmless from claims arising out of your misuse of the Service or breach of this Agreement, except where such claims result from our own negligence.

11. Termination

Either party may end an ongoing service arrangement with reasonable notice. Sections regarding intellectual property, disclaimers, and limitation of liability survive any termination of this Agreement.

12. Dispute Resolution

This Agreement is governed by the laws of Thailand. Any dispute arising from this Agreement will first be addressed through informal discussion between the parties.

If informal resolution is unsuccessful, disputes will be subject to the jurisdiction of the courts of Thailand.

13. General Provisions

This Agreement constitutes the entire understanding between you and Ambervale Archive regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect.

Our failure to enforce a provision does not waive our right to do so later. Notices under this Agreement may be sent to the email addresses provided at booking.

14. Changes to Terms

We may revise this Agreement from time to time. Updates will be posted on this page with a revised date. Continued use of our Service after changes are posted constitutes acceptance of the revised terms.
